Renting Out a Place You Rent: The Lease Gate

City permission and lease permission are two different doors, and the lease is the one that can evict you.

Every short-term-rental guide is written for owners. Renters live under a second legal system the guides skip: the lease. A city license answers the city's question. It says nothing about your landlord's — and the landlord's remedies are faster and more personal than any municipal fine.

The two tracks of renter exposure

The city track is the one everyone reads: registration, caps, fines for unpermitted operation. The private track is the one that ends tenancies: breach of the no-subletting or use clause, eviction proceedings, deposit forfeiture, and damages — in some states including the rent you earned. The tracks run independently. Being fully city-legal while lease-illegal is a common and expensive configuration.

Where the lease is written into the law itself

Some cities stopped leaving this to contract law. Los Angeles requires a notarized landlord approval affidavit for renter-hosts. Denver requires a landlord-permission affidavit for its license. New York's registration system runs only while a lawful tenancy does. In those markets the checker treats landlord permission as part of the verdict, because the ordinance does.

What "permission" has to look like

  • Written. A hallway "sure, sounds fine" is not permission you can produce in an eviction defense.
  • Specific. It should name short-term/platform rental, not just "a roommate" or "occasional guests."
  • From someone who can give it. A property manager without authority from the owner is a common failure point.
  • Kept. Save it with the lease. You will need it exactly once, on the worst week of the tenancy.

If the answer is no

A refused landlord is not the end of the idea — it is the end of this address. Hosted arrangements some leases allow, longer 30+ day furnished stays (which many leases and most city regimes treat as ordinary tenancy), or a different property are the lawful branches. What never works is listing first and negotiating later: the listing itself is the evidence.

Our checker leads with the lease question for renters for a reason — run the check and read both layers before a single night is booked.
